1. PROPERTY & OCCUPANCY

The rental property (“Premises”) is a short-term vacation rental intended solely for transient lodging purposes. This Agreement does not create a tenancy or landlord-tenant relationship under North Carolina law.

Maximum occupancy shall not exceed the posted sleeping capacity of the cabin, including children and infants. Exceeding occupancy limits constitutes a material breach and may result in immediate eviction without refund.

 

 

2. AGE REQUIREMENT

The primary Guest must be at least 25 years of age and present for the duration of the stay. Reservations made under false pretenses will result in cancellation, forfeiture of all payments, and immediate removal.

No parties, events, fraternity/sorority gatherings, or unlawful assemblies are permitted.

 

 

3. RESERVATION & PAYMENT TERMS

• Reservations are not confirmed until payment has been received and this Agreement is accepted.

• Payment schedules may require 50–100% payment at time of booking, depending on proximity to arrival.

• Reservations booked within 30 days of arrival require full payment.

• Accepted payment methods may include major credit cards and approved electronic payments.

Failure to remit payment by the required deadline may result in cancellation without refund.

 

 

4. CANCELLATION & NO-REFUND POLICY

All reservations are NON-REFUNDABLE.
No refunds will be issued for:

• Cancellations

• Early departures

• Weather conditions

• Acts of God

• Travel disruptions

• Failure to comply with house rules

Rescheduling may be permitted at Owner’s sole discretion, subject to availability and applicable rescheduling fees.

 

 

5. DAMAGE RESPONSIBILITY & WAIVER

Guest agrees to be financially responsible for all damage caused during occupancy, excluding normal wear and tear.

An accidental damage waiver, if applicable, covers accidental damage only and does not cover:

• Intentional or negligent acts

• Missing items

• Excessive cleaning

• Hot tub misuse

• Furniture or structural damage

Owner reserves sole discretion in determining damage classification. Charges may be applied to the credit card on file.

 

 

6. SECURITY DEPOSIT

Owner may require a refundable or non-refundable damage deposit depending on booking method. Deposits are returned within 30 days following checkout, less any assessed charges.

 

 

7. CHECK-IN / CHECK-OUT

• Check-In: After 4:00 PM

• Check-Out: By 11:00 AM

Late departures without written approval may incur additional charges equivalent to one night’s stay.

 

 

8. NO PET POLICY

No pets are permitted on the premises unless explicitly approved in writing.

Unauthorized pets will result in:

• Immediate eviction

• A minimum $250 fine

• Forfeiture of all rental payments

Service animals must be disclosed in advance.

 

 

9. HOT TUB & AMENITIES USE

Use of hot tubs, fireplaces, decks, stairs, and outdoor features is at Guest’s sole risk.

Guests acknowledge:

• No lifeguards or attendants are present

• Children must be supervised at all times

• Pregnant persons or those with medical conditions should consult a physician prior to use

Damage to hot tub covers or systems may result in charges exceeding $600.

 

 

10. HOUSEKEEPING & LINENS

A starter supply of linens and consumables is provided. Daily housekeeping services are not included. Supplies are not replenished during the stay.

 

 

11. MAINTENANCE & MECHANICAL FAILURE

Owner is not liable for temporary interruptions of utilities, internet, hot water, appliances, or amenities. No refunds will be issued for mechanical failures beyond Owner’s reasonable control.

 

 

12. ACTS OF GOD

Owner shall not be liable for loss or inconvenience caused by events beyond reasonable control, including but not limited to:

• Severe weather

• Natural disasters

• Government orders

• Power outages

• Pandemics

No refunds or credits shall be issued.

 

 

13. ENTRY & TERMINATION

Owner reserves the right to enter the premises to:

• Address emergencies

• Perform maintenance

• Enforce Agreement terms

Violation of this Agreement may result in immediate termination and removal without refund.

 

 

14. INDEMNIFICATION

Guest agrees to indemnify, defend, and hold harmless Owner, O.L.J.A.G. Ventures LLC, and Divine Vista Cabins from any claims, damages, injuries, losses, or liabilities arising from Guest’s occupancy or use of the premises.

 

 

15. LIMITATION OF LIABILITY

Owner shall not be liable for:

• Personal injury

• Loss or theft of personal property

• Accidents occurring on or near the premises

Guest assumes all risks associated with occupancy.

 

 

16. LOST & FOUND

Owner is not responsible for items left behind. If recovered, items may be shipped at Guest’s expense. Unclaimed items may be discarded or donated after 14 days.

 

 

17. GOVERNING LAW & SEVERABILITY

This Agreement shall be governed by the laws of the State of North Carolina. If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.

 

 

18. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties and supersedes all prior communications. No verbal modifications are valid.

 

 

 

ACKNOWLEDGMENT & ACCEPTANCE

By booking or occupying Hidden Falls Cabin, Guest acknowledges that they have read, understood, and agreed to all terms of this Agreement.
